Sorry this is going to be long!!
Some of you know the saga of my car...
I broke down with it on 8/24/08, I was driving it to my Aunts church upstate NY.
It died as if it wasn't getting gas! I had it towed to my cousins house as her husband is a mechanic. He thought it was the fuel pump. I got the pump for $350
the tow was another $70. He put the pump in and the car would start but then shut down and the alarm was going off. He thought it was something electrical and sent it to a garage Upstate. The guy there Changed the computer and also removed the electric start as he said that's what caused the computer to go bad. I went up on 9/24(I took the day off from work) to pick it up! It took this guy a month to figure this out! My daughter and I went up! I paid the guy $776. I drove 2 miles and we stopped for coffee went to start the car and it wouldn't start. Called the shop where I had just picked it up from and they came and picked it up. I still had the rental Thank God! I went to the shop an hour and half later, because I was fuming and needed to calm down! The guy told me he had driven the car 40 miles before I came to pick it up and he had no problems... I told him he was BSing me. He said our conversation was over... I didn't hit him! I explained to him that he has to see it my way. You have had my car for a month you just charged me $776 to fix the problem and it's having the same problem it came in with?? I stayed up there all day and I finally called him at 4:30pm he said the computer was bad and he would have to get another one?? He had told me he had gotten it from the Chrysler dealer up there??? So I went back home without my car! Now I am still paying for the rental! I call him the following Saturday and he says he hasn't gotten the new computer and it would be in on Wednesday the following week! That following Thursday I call him and he says that the part hasn't come in yet?? I ask him has he called the dealer as to where it is? He tells me that he should have it today! At this point I'm going to lose it!! I call my cousin(I have been talking to them every few days! My cousins Husband(The mechanic) Tells me to let the guy know that when The car is done he will pick it up and drive it for a few days before I come to pick it up... So Last Saturday 10/4, I get a phone call from the Shop that my car is ready??? I tell the shop that I will get a hold of my cousin and he will pick it up! Now It's Saturday at 11:30am the shop closes at 12pm. I call my cousin and her husband is Out we can't get a hold of him. So I call the shop and say that my car will be picked up on Monday. My cousin goes there at 8am to pick up my car and it's gone and so is the shop owner. So my cousin(Actually her husband) Leaves a message for the shop owner to call him as to when he can pick up the car?? I call my cousin on Tuesday and they still don't have the car? So I call the shop and the guy is not there! I leave a massage as to have him call me back as soon as possible! Now I am planning to pick up my car on Thursday as I don't have work and my BF will take the ride with me to pick up the car?? I finally get a hold of the guy on Wednesday afternoon at 4:20 he never called me or my cousin! I tell him I am going to come pick up my car! He goes sh** Your cousin is not going to pick it up and drive it around??? I tell him that he was there on Monday to pick it up you and my car were not there! He say's he never got the message or my message That my car was in the back? So he says he's going to have one of his guys drive it home that night and to call around 8am the next morning... So on my way upstate this is a 4 and1/2 ride so we left here at 6am. I call he says my car was driven about 40 miles the night before and there is no problem come get it!! We get there and pick up the car stop at my cousins for a little while and then stopped for lunch and then drove all the way home. My BF drove the car down as I still had the rental(Which I have paid over $900 for so far) and I was the driver on it!
We get home safe and sound! The next morning I drive the rental to work I was going to return it today Saturday?? My Daughter takes my car to work she goes to leave work and the car alarm goes off(He removed the alarm/electric start??) The car will start but it dies as if it's not getting gas! She calls me and I come home from work and we go to hopefully get the car(She got a ride home). I try my Key The original key and the alarm goes off and it will not stop?? I go down to my mechanic and tell him this he tells me to go try several things to see if I can get the alarm to shut off, None of them work! It will start but it shuts right down just like the original problem... I go back to my Mechanic and he has the car towed to the shop!! It is there now I have no idea how I'm going to pay for this as I have spent more $ on this car in the past 6 weeks And It was supposed to be fixed??? I don't know if I can sue the shop upstate for not fixing my car! I don't know what to do??
I'm sorry this is so long but this is what has happened!

PS He didn't charge me anything for the past 2 week's and didn't give me any type of paper work after the original fix of $776

Holy cow Dorie! I would be looking into some kind of legal recourse and if not that then call a news station and see if they can investigate this mechanic and get some if not all your money back. Something smells rotten. I wish I were more knowledgeable about cars to help you out, but I have no clue about them.

Get a lawyer. You will need all your paperwork and I imagine a letter from the new machanic. If new parts where put in your car, ask to see the receipts that show when and from whom they were purchased. Once the machanic that did the shoddy work knows he is about to be sued he will try and set up his side. The more you have documented the more you can turn over to a lawyer. Good luck Dorie.

Dorie, I asked Wayne if he knows what kind lawyer, he thinks just a general/all around lawyer or he mentioned contract or consumer law lawyer but doesn't know if that is really just a general practice lawyer that has experience in that type of stuff.

call the dealership where he got the parts from and ask for copies of the recipts since he did not give you paperwork (BTW never leave a place without paperwork stating what was done and with itemized costs) But you can also find out if he even ordered the parts that way.

Darn Dorie that just sucks, even though it says he changed it I would check with the dealership where he says he bought it and make sure that he did that. Good luck and hugs and prayers for you.

I'm sure my mechanic will make sure it's a new one I trust him and he will tell me if it's not he was shocked at what the invoice said and he said it made no sense?? I trust the guy who has it now and I know if he can fix it he will and not charge me an arm and a leg!

Get a Lawyer and definitly stipulate reinbursement of fees spent on the car add time for rental and gas both ways each trip and for the new mehanics fees!
