argh, frustrated

  1. I am so frustrated with my apartment building management right now. We have not had hot water for 3 days. I call my superintendent and he says it would be fixed by yesterday night. Nothing. Call again, he says this morning. Still nothing. Now he is ignoring all calls, and I call the main management building and nobody knows what is going on. I had to boil pots of water to take a bath in since it is too cold to shower and I only own 2 pots so it took almost an hour to fill up the bath tub to a comfortable temperature. This is driving me insane, I don't know why he won't answer his phone anymore. I'm starting to wonder if this well ever be fixed. Sorry, I had to rant.

  2. If not even going over his head gets any results...I understand your frustration Gini. :o( Have you a friend nearby where you could get a proper hot bath til it's fixed? Not ideal I know...

  4. MCW unfortunately I don't know many people around here. I'm in college so most of the people I do know stay in dorms and go home for the winter, but I stay in an apartment and am here all year round.

    Linda I don't, although that's a great idea if I did. It's a building with me and 6 other apartments in it, I talked to my neighbors and they aren't getting hot water either and we are all very frustrated. I'm not sure what to do next

  5. Go to the main management offices - all of you - and refuse to be moved until someone sorts something out. Sometimes only beligerence works.

  7. Try telling them you'll all expect a rent rebate for this lack of basic service, and put in in writing. Detail an amount per half day the problem isn't fixed. That should get 'em moving.

  8. ...and then deduct the relevant amount from your next rent cheque. If it's a reasonable amount, I doubt they could file any counter claim against you, particularly if you all do this together.

  9. sweety you need to call your local housing athority asap. They are required to provide basics like that and fix problems in a timely manner.

  12. Send the main management offices a letter of complaint detailing how you'll
    be expecting a rent rebate for however long you'll have gone without this basic
    sanitation service if it doesn't get repaired in a timely fasion. Send this to them as CERTIFIED MAIL. That way they'll have to sign for it, thereby acknowledging they've receieved the information. AND contact the local Housing Authority and have them put on notice regarding this situation.

  13. It has been a while since I dealt with NYC, but my recollection is that your rights as a tenant include hot water, and that you can withhold partial rent as a remedy. I also remember, as others have said, that the housing authority provides a forum for redress.

    I woulnd't be too hard on the Super. He is probably not answering the phone so he doesn't have to lie to the tenants about when the problem is going to be fixed, because he probably doesn't have any idea. It sounds like there is a major problem and I suspect that the building owner is trying to negotiate the cheapest fix possible. The poor Super is stuck between a rock and a hard place on this one -- and that ain't a comfy place to be.

  15. I agree with Tigger. You need to write a certified letter to the property manager informing them that you can withhold rent in a separate bank account until they provide you with hot water. The California Civil code calls it a warrant of habitability: implied warranty of habitability - a legal rule that requires landlords to maintain their rental units in a condition fit for human beings to live in. A rental unit must substantially comply with building and housing code standards that materially affect tenants' health and safety. The basic minimum requirements for a rental unit to be habitable are listed in the Dealing With Problems section.

    Sending you lots of positive thoughts that it will work out and sending you hugs too. If you were nearby, I would lend you my shower or my gym membership card to use their showers.

  16. I have had similar rental situations Gini, but never in a city like New York. I would call the Management Office and Housing Authority. What a terrible time of year for such an inconvenience. I hope they fix this soon!

  17. Gini, Is there a YWCA near you where you could go and explain your situation. I'm sure they would help you at least as a place to get a hot shower. Just something you might consider. Best wishes you find a solution soon.

  18. Thanks, for an update last night a guy knocked on my door and asked if the water was back on. I checked it and said no. Then an hour later it was back! I got in a quick shower and was excited. However, this morning it's frigid again. I don't know what is going on, but at least I think they're doing something to try to fix it and at least I got in a quick one last night. I will call again today just incase if they didn't realize it's off again. This is horrible in the winter, sigh. Hope it fixes soon. At least there was that glimmer of hope last night.

  19. That sure sounds to me like they're attempting to tackle the problem, gini.
    If that's so, just be patient a little while longer. It would be good also
    to call them today in case they thought they had it corrected yesterday.

  21. That sucks, Gini! Isn't it amazing how much you miss things normally taken for granted when you don't have them? Grrrrrrr to landlord! Perhaps the landlord would let the tenants come to his/her home to shower!

    During the last hurricane here, I had cold showers for 8 days in a row, but at least it was 90 degrees outside.

  23. If the landlord would communicate it would help. They need to let you know what is going on even if they don't know how long it will take. My landlord never communicates unless it is to raise lot rent. He changes things like garbage pick up or the water goes off or is turned off for some reason and he never lets us know what is going on.

  24. Still nothing!!! It's late now so we're calling again tomorrow. I'm thinking about trying out a 1 day trial membership at the gym near us just to use the shower.
