Judge attacked in courtroom

    For those who think judges don't have difficult and sometimes dangerous jobs, here is an example of the risks taken by members of the judiciary and others who work in our judicial system.

    It's fine to take exception to the behavior, rulings, attitudes, etc. of any particular member of our legal system. But it is disturbing when society has sweeping negative viewpoints of everyone involved in providing overall law enforcement.

    So next time you earn that traffic/speeding ticket, be polite, be considerate, show respect and generally be greatful that police, judges, lawyers, court workers, jail officials, etc. and members of the public called to jury duty are willing to take the risks to keep the rest of us safer than we'd be if we let our system of justice wither from lack of respect and support.

  3. I don't know if that would help, AZ. I've often watched a show called "Disorder In The Court" and these things happen so suddenly that nobody really has time to react. I've seen guys cold-cock their attorneys, jump the rails and go after the accused - it's insane. You don't really expect people to snap and start attacking judges, attorneys, etc in the courtroom. But it does happen, and it's scary.

HM, don't know about California courts but in AZ if a person is brought into the courts for killing his girlfriend, he is schackled at the waist, at the ankles and also has handcuffs on that are hooked to the waist. From the report it sounds like he was not schackled at all if he could jump like that.

  5. I'm not sure shackles are the answer. Imagine how fair a trial someone would get if the jury only saw them in shackles. The assumption would be that the defendant was guilty even if he/she wasn't.

    Maybe something that divides the area where the judge, jury and court officials are from the rest of the courtroom would help. A 3-4 foot piece of plexiglass would at least slow someone down.

    At least in this case the judge is okay and the good citizens of California aren't going to pay the expense of trying (twice) then feeding and housing this guy for 20 years.

  6. how scary !! i would hate to be a judge, they are angels for that job. my dad was a lawyer for 30 years. he told me many horror stories , he prosacuted ( excuse the spelling ) for many years. he is retired now and all the people he put in jail are getting out. 3 years ago he was coming out of the market and he was run over, he told me " one minute i was walking across the parking lot the next minute i was in his windshield". he was almost killed, the man is back in jail forver and my dad is doing well.

  7. Marnet, You are excellent on your soapbox!! It's a statment that needs to be said! I don't know how many times Ron and I have sat and watched Cops or Disorder in the Court and said to each other "No way I could do that job". If not for law enforcement and our judicial system we would live in total mayhem! They have an increasingly tough job, but head out to perform it everyday! I know everyone here would be devastated if anything happen to our Kitten Whisperer or anyone of our other TDK family while they were working to keep the rest of us safe!

  10. Thanks for the support for the judicial system! It is scary to read about attacks on judges, lawyers, deputies and even parties in a case. Everyone in the courtroom and courthouse should be able to count on being physically safe while going through often highly stressful proceedings. I trust our county deputies with my life. I was joking with one once and asked him if he'd take a bullet for me. He became very serious and without hesitation said that he would.

    The deputies let us know if someone might present a problem. If we think a person who is not in custody is likely to "go off" during a court proceeding, the deputies will come sit in the courtroom to make sure that doesn't happen. We also have a panic button in each courtroom and in our offices if a disturbance erupts. The deputies come running. It's amazing how well-behaved people can be when there is a cop in the room! :)

    Dangerous inmates are cuffed and shackled with the handcuffs also attached to a belly chain. The best they can do is shuffle along and they can't raise their arms to strike anyone. If the proceeding is a jury trial, great care is taken to get the inmate into and out of the courtroom without the jury present so they can't see the restraints being used. We attach a cloth skirting to the front of the counsel table which hides their legs if the ankle shackles need to remain on while the jury is present. They are dressed in civilian clothing during jury trials.

    If a person is behaving violently, or too mentally ill (e.g. refusing to put on clothing, etc.) to be brought to the courtroom, the judge, attorneys and court reporter go to their cell in a segregation unit to arraign them.

    Design mprovements can be made to increase security in the courtroom. Our courthouse is built in the early 1960s and didn't have any kind of security. Members of the public could walk in and go directly to a judge's office if he/she wanted to without being checked for weapons. Our building has now been retrofitted with airport-like screening machines. Weapons are not allowed into the building. Unfortunately, judges end up using the secure elevator inmates are brought to court in and sometimes share the elevator with them and the deputies who are transporting them.

    That all said, there are still concerns about the safety of judges, prosecutors and their families outside of the workplace. Please keep us in your prayers. :)

  11. KW you and all those who put themselves in the line of danger in order to keep the rest of us safe are always in my prayers. That must me scary and very uncomfortable to share the elevator with those in custody, I sure hope at some point they can make other arrangements. That is very tight quarters with no exit to share with a person who could very dangerous!!!

  12. The deputies put themselves between us and the inmates. If the elevator is too full, we wait for it to come back empty. If a deputy thinks it is not safe for us to be on the same elevator with a particular inmate, they ask us to wait. What we really need is a new building. This asbestos-infested place is a nightmare to keep up for our county as it is.

  13. Yikes!!! asbestos?? still in our courthouses??? You would think the liablilty involved would justify a new building. We have one courthouse here that is very old and very beautiful, but had many of those problems, they build newer courthouse next to is while doing a total renovation on the old one. By the time they were finished we had a need for both.

  15. I've been following this since it first happened. The crime rate is so rampant in Stockton & the courts there are really careless when it comes to security. It didn't surprise me one bit that this happened. It's the very reason I refuse to go to that town for anything by myself.Anything pertaining to county has to be tended to there,so I simply do without things I'm eligible for in the line of help thru the county. That includes any medical.
    It used to be a nice little town 20 yrs.ago. Now, it's a place where alot of scum hide out. And there aren't enuf police officers or Judges to get thru it all & now Cali. is talking of reducing those numbers? What are they thinking?

  16. Thank you Marnet for the link. KW, you are in my prayers that you and your coworkers stay safe. At one time I had to go to the Marin Civic Center (if you have seen the movie Gattaca it is the big blue building in that movie) to be on a jury and I recall that another trial was on and they had so many deputys out in the hallways near the metal detector and in the area. I am sure they had many more inside. I recall asking someone what was going on and they told me it was a murder trial. Very scary for all involved!

  17. Feral, I'm sorry that you have to do without so much because of the conditions in Stocton. I see more and more frightening stories coming from there. For some strange reason it is one city that has really grown in size, but other services have not kept pace. I can't imagine how scary it must be to the good citizens and the few law enforcement officers they do have.

  18. I'm so glad the judge wasn't seriously injured. I think of our dear KW all the time and stories like this one is such a reminder of how vulnerable our judges and courtroom officials are with these rabid, lawless pieces of garbage that we're dealing with these days.
    Susie you shouldn't feel that you can't go in and get the help you so desperately need and deserve. It's not like these attacks are so very random that you can't frequent the offices of the county. The courtroom however is a whole different story. The worst of the worst is paraded in there and with the financial difficulties now days....these areas truly don't get adequate staffing.

  19. Trust me Sis when I say...the outside of the county building looks like a homeless shelter/drug dealing/dumping ground for garbage. There are not enuf law enforcement to cover all of San Joaquin County & sadly, one of the most important offices necessary are in an area where few of the enforcement travel.
    Because of the seriousness of the charges on this guy, he should've been in shackles or have some kind of barrier up to protect the judge presiding over the case.And I have to say...I don't think that this lack of security is in all the courthouses. This area of the county is just not prepared for surprise violence such as this one that occured.

  21. Susie...maybe someone should contact the mayor or the city council people and make a complaint as to the area surrounding the city offices and the lack of patrol by officers. The squeaky wheel gets oiled first. Send a letter to the editor of the local newspaper and make some noise. It could be that there are alot of people in your position who feel the same way and aren't getting the help they need. I worry so much about you little sis. XOXO =(

    Julie....apparently the sheriff didn't take her seriously enough. Even though they did search his cell...apparently he found a clever way of concealing the weapon on his body. With warnings such as those.....he absolutely should have been shackled. You just know...this will never happen again. Not in the capacity in which it did. These bad guys who are seriously disturbed really do have a way of surprising everyone...Why? I'll never know.

    Perhaps we should all let our government representatives know that the "stimulus package money" should be FIRST allocated to repairing/retrofitting/replacing government buildings like the (asbestos ridden) courthouse KW works in.... AND upgrading/retrofitting/improving local water, sewer, and REAL infrastructure that has been neglected for many years all over the country!
    /rant off....

    KW, hope this happens with the "stimulus package" in your courthouse!

  23. Thanks for the sentiment, KM! I know there won't be a new courthouse in my lifetime on the bench. There is still asbestos in the building, but it was "abated" about 15 years ago where it became exposed and posed a health hazard. We see the abatement guys in their moon suits every few years as a new source of asbestos is exposed.
