  1. Hey all I know I haven't been here in while but I've kept in touch via e-mail and facebook! I miss all of you that I have not spoken too and also welcome all the newbees! Ok I am asking for prayers for myself on Tuesday one of the students I work with(I work with special ed kids) attacked me and threw me into a door, I am bruised on my back where the doorknob hit, I also have a bad bruise on my arm from where he grabbed me, also it seems that I have torn My ACL in my left knee. This is not totally confermed! I was seen at the Er yesterday and now am in a immobilizer and on crutches! I will hopefully be seen by the orthopedist today! I am in agony with the knee, the rest is just sore! Have any of you tore the ACL? did you have to have surgery?
    also I have another issue with this student! The place I work at have been fighting the district that this student is from to get this student an individual aide,I am the classroom assistant, I'm supposed to work with all the kids but since he doesn't have an aide I work with him 99% of the time! This is the 3rd time this kid has hurt me the other 2 were not as bad! What should I do? someone from work is saying I should sue the school district because we have asked for 2 years to get an aide for this kid! At the begining of this year they OK'd an aid for 3 months(Actually it was for 90 days and that included week-ends?? were a school, so are they we don't work week-ends) This kid improved over the 90 days and they refused to pay for a fulltime aid?? the other thing is he was so bad on the bus attacking other students that he now has his own bus with the driver and an aide? I don't know what to do? I know there are a lot of smart people here and I need some opinions!

  2. Dorie, so sorry you are going through this. When I worked for a developmental preschool, we had an autistic child and needed an aide for him. What worked for us was having a therapist and a doctor explain in writing what the benefits would be for the child and for the other children in the preschool.
    If he is physically abusive to everyone, he does need one-on-one attention and the school should see that it would be a win-win situation for the child, the other children, and the school.

    I'm sorry, Dorie. I'd look into suing someone, too. It's not right that you should fear for your safety around this kid - especially since it's been a problem for a long time and noone has done anything about it.
    The kid (she's 20 now) I used to watch plays soccer and tore her acl twice. She had to have surgery both times. When will you get the results?

  4. Dorie..I would have to agree to file a lawsuit..You have been hurt 3 times by this kid..You have to take off work and it has affected you physically and I am sure mentally as well. Maybe that would send a message to the school district that this kid needs one on one. I am so sorry you are dealing with all this. You definitely have my thoughts and prayers!!!

    You would think that hiring an aide would pay off for the school in reduced medical expenses and legal exposure. Unfortunately you may have to get some legal advice.

  6. Dorie! I was just thinking about you a few days ago. Must be the TDK ESP ;)

    If this boy is being abusive to everyone, then you should point out to the school board that even if you don't sue them, someone else probably will. There is no excuse for a school that doesn't protect it's staff or students. As for the ACL, my brother tore his many years ago and as I recall he didn't need surgery but he was on crutches for awhile. However, I suppose each case is different. I hope you heal up soon - it sounds very painful.

I'm hoping to go to the orthopedist today! the hospital wanted me to go yesterday but my orthopedist is off on Wednesday(Just my luck) I'm going to change my name to 4 kits(It explains my babies) Azalea the wild one is back we can't seem to win her over who ever had her before really made her miss trust humans I can't even get a picture of her! She's living in the wood shed and takes off when anyone goes near it! we have made a bed for her and we feed her in there! she leaves us critters by the door almost everyday as a thank you but she will not trust anyone! the other 3 are fine living it up in the sully homestead! we've started walking Chucky with a leash outside he loves it and now drives us crazy meowing because he wants to go outside all the time! The girls are doing good Tonka has gotten fat so her new nick name is fatty ding dong(The kids made it up)

    we have all the documentation saying he needs the aide but the districts attitude is there are 6 kids in our room and 5 adults we can take care of him! It really pisses me off because my job is to work with all the kids. Not just one!

  9. Dorie, I have to agree with the others-file the suit. Even though I am against "frivolous lawsuits" this is NOT one of those. You have been physically injured! And not just once, but 3 times. If the district can't properly take care of their employees and guarantee their safety, then they need to be brought to heel and fast. You should not be put in danger just to satisfy the bean counters!

    It's good to hear from you, but not under the circumstances!! I totally agree that a lawsuit is necessary--3 strikes and you're OUT! Actually this situation should have been taken care of long ago according to your reports.
    I hope the school system is paying for your medical bills.

    Please take it easy, know that you're in my thoughts and prayers every day, and I hope the ACL injury doesn't require surgery.

  11. Ok I just got off the phone with the orthopedist and work... Earliest appointment with the Dr is Monday at 2 pm. It's gonna be a long week-end! As for work the principal is having a fit has been on the phone with the district since yesterday, she's going to call me later to let me know what's up!

  12. Dorie, so sorry you have been hurt. First of all, your injuries should be covered under workman's compensation, second a lawyer is a good idea as you have now been injured 3 times. Third, you might also want to schedule a couple of counseling sessions for yourself so that you have an objective professional to help you sort out your feelings on getting hurt and going back into the classroom. I would be afraid to be around that child in the future knowing that he is capable that level of violence.

  13. I agree Dorie. File the suit, and in the meantime, refuse to work with the abusive special needs student. I bet any lawyer worth their salt would agree. Do check with a free legal aid service to see what, if anything, you can do.

    I sincerely doubt you could be fired for refusing to allow yourself to be placed in a dangerous situation -again-. Most states have laws regarding Safe Workplaces and I would look into that as well.

    DEFINITELY seek legal aid, and be ready when that principal calls you.

    Thank you for that advice! Workmans comp will cover all the medical issues, That's why I had to call work to get the information I needed! I'm just so agrivated by all this!

  16. Dorie, I agree with the others, some sort legal action needs to be taken.

    Regarding the torn CL, my husband tore his years ago, before I knew him. It took ages for them to confirm that it was actually torn. Initially, they just diagnosed a sprain or strain or something. I think it took an arthroscopy to finally confirm that it was torn. Then, he still didn't have surgery for several years. He was alright at first, but eventually, his knee got weaker and weaker, and every now and then the knee would give way. (Once very dramatically, as he was running on a cricket pitch. He had to be carried off!) Other times he could feel it start to go and would be able to stop it. At this point he decided that he did need to go ahead with the surgery. Plus the doctor was saying that not doing so could cause problems with his back and other things, because of constantly favouring that leg.

    SO - he had the surgery about 8 years ago. There was a lot of pain at first, but that could have been avoided if they'd given him enough of the anti-inflammatories. Anyway, he was back up and out and about in no time, and now his knee if better than ever. So, if it does turn out that you've torn your ACL, I would recommend going ahead with the surgery right away - it will probably be easier in the long run.

  17. Dorie, I don't know about the legality side of this. But, as for your torn ACL, the surgery is so much easier than it used to be! It used to require a rather long incision on the inside of the leg. In the Army it was always called the "smile" incision because that was the shape. It was a pretty common injury in the Army. Now the surgery can be done by arthroscopic, which requires only a tiny incision through which the scope is threaded.

    What you want to ask your ortho surgeon is how many of these has he done? You want someone who does this surgery on a rather routine basis.

  18. Dorie I'm so sorry to hear this,I am angry for you. There is a difference between dealing with a difficult child and letting a violent child run rampant.IMO he should be in a secure facility(his own bus and driver???).
    I agree with seeking legal advice. I'm sorry you're in pain,keep your leg elevated and iced as much as you can and stay off it. [[[[[[Hugs]]]]]]]

    This is one of the hardest things to deal with - the violence in schools by special needs students - some of whom are much bigger than the teachers and aides and don't even realize that they can hurt someone so badly. This kid should have been more closely supervised after the first attack and the school is responsible for your injuries. Definitely see an attorney - you do have a right to be safe at work and the school board knows this. Many prayers coming your way for a quick healing.

  20. Oh Dorieduck my friend! How can this district be so lacking as to endanger so many? Absolutely you must seriously consider the lawsuit. Too often these are the actions that will force them to implement policies to better prevent this from happening again. This should never have to happen. You must consider the long term effects any injury presents and this injury would likely have never happened if there had been a full time aide assigned to this student. His anger and lashing out without one, dictates his needs as well in this situation. Keeping you in my prayers along with this student who obviously needs additional professional attention.   21. This is just awful Dorie. My best wishes to you and I hope that the othopedist can help you and get a diagnosis quickly.
    I don't know much about the legal issues, but at the least I would say that it would be wise to get legal council. Surely at the very least thay can put pressure on the school to ensure your safety going forward. Please document everything.

  22. Unfortunately this is not an uncommon issue. My mom was a special ed aid for a very long time and had to eventually move on because of physical problems. Just like KarenCentennial said most of the time even the 5th grade boys were much bigger than my mom and she couldn't be expected to take them on when they misbehaved. This is also so sad because the boy is obviously frustrated too and it's a shame he's not getting the help he needs. It all comes down to money and the school district not wanting to shell it out. In my Mom's case she also delt with people instisting all those extra costs should be solely the parents responsibility if they wanted their child in school. Very sad.

    I hope your knee is ok and just want to let you know that there are many people that wouldn't be able or willing to do the work you do. It takes a very kind and patient person to do your job and I commend you for that. Please don't let this incident of very poor judement by your school district distract from the bigger picture of how much you're doing to enhance the lives of these children.

  23. Prayers and white light for you, Dorie. It sounds like you've already filed for Workmens' Comp, but you probably should consider going ahead with a civil suit if you can document the district's refusal to provide a safe workplace. Hopefully it will at least make them perk up their ears and listen to you and the other teachers and aides.

  24. You need to hire a lawyer who specilaizes in workers' comp cases. In most states he/she is paid out of your award--no retainer from you is needed. And in most states you cannot file a separate lawsuit against your employer unless gross negligence can be proven, hence the need for a lawyer in your case for sure. My daughter worked as a camp counselor for a school and was punched by another older counselor (a boy!) breaking her nose. We won a lawsuit, even though it was workers' comp, because there were records of his attacking other students in the past and the school/camp continued to hire him.

  26. Dorie, I am sorry you are going through this and got injured. I agree with all who have said seek legal counsel about suing the school since you have been injured three times now. I agree with Siobhan in all that she states especially about refusing to work with this kid who has injured you three times. I played soccer for six years (two in junior high and four in high school) and was very lucky to never had any injuries other than some shin splints and a ball shot into my face (no injuries as it hit my right side of my face but left a red bruise that eventually went away).

  29. I don't know where you live Dorie, but I'd definitely do a google search of the special education laws in your state. Here's a great article:

    CALL THE POLICE so that there is ample documentation!!!!! Are you part of a union? If so, contact them and ask for information about their lawyers.

    Is there an alternative school in your district--or is that where you are working? If you're at the regular school setting, I might be able to give you some advice as to what to do---but, it would be based on how I would do things as a special ed. teacher in Texas. I'm so sorry you're going through this--no one should have to work in setting that scares them. Please feel free to email me if you need to! smeryl at sbcglobal dot net :)

    Also--the teacher across the hall has the transitional students (ED students). He's currently working on his admin. certificate and is 'the one to ask' on anything related to special ed. I'll get his advice as to what he'd do if his aide was injured by a student
