Dorie first let me say I am so sorry this happened to you! My prayers of healing are heading your way.
Fondahonda has wonderful advice. You belong to a union and pay dues for a reason. Please let them go to bat for you. This is the 3rd time being assaulted--call the police and have it documented. I understand he is special ed, but his behavior must be documented.
Dorie you have been an angel to the kids you have worked with. They love you and need you. Please stay safe and know how special and loved you are.

I'm sorry you have been hurt, both physically and, I'm sure, emotionally. The work you do (teaching) isn't easy, isn't appreciated by many, isn't well funded but is extraordinarily important.
If your goal is to have the school hire a full time aide for this child, maybe instead of suing for a monetary amount, you could ask for all your missed wages and medical expenses (obviously) and that the school hire a full time aide NOW in exchange for your not suing them for anything else. If they would sign an agreement like that, then everyone would be better off.
But I agree with the others who say to contact the police. Not that you want the child arrested but so that you have a legal record of what has happened.
The school district needs to know that you aren't willing to be a doormat, and the public needs to be aware of the type of situations special ed teachers can be exposed to.

Hey all
This is what's up I went to the orthopedist today I have a severe sprain of the lateral collateral ligament and a possible hairline fracture of the fibula!
I am in the immobilizer for 3 to 4 weeks and also out of work! I just got off the phone with my union rep. she says I have a case against the district unfortunatly my unions lawyers will not help me and I would have to hire a lawyer If I want to persue it! I have a lot of thinking to do!

What has the school district done so far? Have they even contacted you or has all your contact been through the union?
You are going to find that the immobilizer is worse than the pain of the sprain and fracture. It's no fun being off work if you can't do anything to occupy your time.
You are being paid while you are out, aren't you? And not just the pittance you get from long term disability, but your full salary. And they should be paying ALL your medical bills with a doctor of your choice. If you need to have in-home help, cooks, housekeepers, etc., send the bills to the district.
Even though you probably don't want to see the boy arrested (he sounds as much a victim right now as you), you do need to file a report with the police. It needs to be recorded.
You can talk to some personal injury attorneys; you may find one who will take the case pro bono or on contingency. But you need to know what it is you want from the school district before you sue. If what you want is for them to admit they erred in not hiring the aide they promised, and to hire him or her post haste, your suit will be different than if you sue them for gross negligence and/or dangerous working conditions.

Oh, Dorie. That's terrible. It's dreadful that you have been so badly injured, it's horrendous that you can't work and it is totally appalling that your union will not help you. What the hell do they think they're there for? (Pardon me being unfluffy. I used to be a union delegate here in NZ and IMHO this is EXACTLY what unions were created for, to protect workers.)
I don't know anything about the US legal system so can't help there but this is just plain wrong, on all fronts. My thoughts are with you and I am VERY angry on your behalf. Many, many {{{HUGS}}}

Ok let me clarify things! I can't call the cops as this child has severe autism That's why I work with him! I am getting paid my full pay plus medical expenses(Compensation) and also lot's of cards from all the kids I work with! As for the union I also wonder what it's for and I think I may make a few more calls to the union lawyers to make sure the information I have received is correct! It doesn't seem right!

A disability doesn't give anyone the right to physically hurt anyone else. Please reconsider calling the police--this needs to be reported. This has probably happened a lot more than you know and people don't report it 'because he has autism'. I teach special ed., Dorie, and I wouldn't hesitate to call the police if any of my students hurt me--especially if it's happened more than once. Maybe it will, at least, open up the school's eyes that you're serious about taking a stand on this and that something needs to be done IMMEDIATELY. Dorie thank you for checking in--I was looking for you! Now I am in a similiar boat with FH. I also work with special ed. I have worked with very violent children, and I am here to share that you need to hold them accountable. Please have a police record of this. I know that you are worried about your student, and you have feelings for him. You are a good teacher, but he and his parents must be made to realize that hurting people isn't a solution. I think this is more for his parents than the student. They will be held liable for the actions of their son. A beloved University professor was murdered by her autistic son, he will be held accountable for his actions. He doesn't comprehend what is happening to him. If he had been held accountable for all the physical violence he inflicted before, maybe there would have been some interventions that would have saved his mother's life. Please Dorie this is serious because YOU are important to me. You worry about your student, but I worry about the one that matters to me--You!

Dorie, for whatever it's worth...I'm coming in late on this because I've not been on TDK much the last few day due to work and hunting for new apt. I'm so sorry this has happened to you. Both the physical and emotional stress are enormous and I hope you'll continue to take care of yourself on both fronts.
In deepest empathy...I work with seriously emotionally/mentally ill people at a partial hospitalization clinic. We are threatened on occasion...I've even had things thrown at me hard enough to break against the wall. We never hesitate to call the mental health sheriff for intervention. We have to take into account their own protection, the protection of their peers, and the protection of the entire staff. I'm with SM. You simply must make a police report. There's a lot to consider here...you (incredibly precious to us), his fellow students (precious to their families), and then there's you again...a special ed teacher who can't be replaced.

Oh Dorie! I can't believe that your union won't be helping you out with bringing a lawsuit! That really doesn't sound right.
One thing I was glad to see was that you haven't snapped your ACL. 3-4 weeks in an immobilizer is not good, at least you but you won't be needing surgery!

I really admire you Dorie. My step-daughter taugh autistic children for about 3 years and what a tough job. And luckly her students were much younger and smaller. It really takes a special person to do the work you do, and although you are enduring all of this, you will have a reward waiting for you!!!

Karenopa - an immobilizer is exactly that. It's a cast of sorts (I think make of metal/cloth/straps/velcro) that immobilizes the knee/leg. Prevents it from bending/stretching. See examples here

{{{Dorie}}} I used to work with the MR adults. You may want to check your original contract and see if there is a clause in there prohibiting you from suing. I know when I was in the field, all of those matters were to be handled in-house and filing police charges/legal charges were prohibited as it was a breach of confidentiality! Stupid but true.

Dorie, you might want to consider calling your county's department of social services if you are not willing to call the police. End of the day in addition to protecting yourself, I know you also want to serve the child's best interest. Getting Social Services involved may be the exact catalyst needed to get this child the individual attention that he needs. It also serves as an official report to document your side of the issue. Glad that you are being taken care of for medical and salary.

KYKAT has hit upon something. Social Services is required to look into anything reported. It might at least let everyone get on the same page.

Just a quick update My leg is feeling better! the swelling has gone down but i'm still having pain if I put weight on it and thank God the throbbing is almost all gone!
I am calling a lawyer tomorrow(a friend gave me his name) I don't know if anything will come of it and I found out Saturday that I do have a summer position waiting for me so that is a load off my mind at least I am employed for the summer the hours are great this year 7:45am to 1:45pm I'll be home by 2:30. I'll have most of the afternoon to spend with my youngest son! Yea(He's not too thrilled as he will be 14 this year(Mom is an idiot) But at least I will be able to keep a better eye on him!
