  2. Just one more thing: the pleading was filed electronically, which means his signature was just /Boss/. He didn't see it before it was filed.

  3. The buck still stops with the attorney. It sounds like this practice needs to have an extra step built in for the attorney to review anything sent electronically to the court.

  7. Bellantara, there's not much more that I can say except to echo everyone else and to tell you that you are in my thoughts and prayers.

    Do you think that, after a day or two, you could make an appointment with your boss to discuss all of this? You just don't end a five year relationship in anger and maybe that is what it was on his part. I am hoping so, anyway. I would just love to see a profession where someone never, ever makes a mistake. We are only human and all of us have made mistakes in our jobs.

  11. I know you feel sick and frightened. Have courage. I just Googled Paralegals in Atlanta GA and got a long list of jobs posted within the last week or so. This means the market is not dry.

    Talk to your boss after he has had time to reflect and when you talk to him have a QC process to pitch for preventing the future occurrence of such a mistake. By showing concern for improving a process no longer considered your province you underscore the wisdom of keeping you in his employ.

  13. Hey, I am sorry you made a mistake and lost your job. I sympathize.I hope that finding another is a quick process. Contact your references and let them know that you are out there searching. I wouldn't give the last job another thought, but just get going :) Elizabeth

  15. Prayers and good wishes go out to you Bellantara, I agree with everyone it seems to be a drastic over-reaction on your boss's part. Hang in there, I know its rough, been thru being fired myself without notice and it shakes one to the core of their soul.

    It sounds like your boss reacted out of anger. Hopefully, he will come to his senses and realize that he 'flew off the handle' and will beg you to come back. If not, you might consider emailing him /dropping him a note just to let him know that you're sorry you made such a hazardous mistake and that you just wanted to let him know that you have both enjoyed working with him for the last five years and the experience that you gained working with him will help you in your job search. This may be a way for him to not have to 'eat crow'. Keep your head held high--everyone makes mistakes and I have a feeling that he will come to this realization.

    Personally, firing someone for making a mistake that's relatively easily fixable, even if it was a high-profile mistake, seems a bit much. Hope your next boss allows at least one or two mistakes over a 5-year period. If you're not occasionally making mistakes, you're not stretching your abilities.

  22. Bella, I am so sorry to hear this. I agree with the others-your boss over reacted and his anger was unfair. We all make mistakes, and if you have been there 5 yrs and are a senior paralegal then obviously you are good at your job. If he doesn't coll off and let you back, I would indeed investigate filing an unlawful termination suit. Normally you do have to establish a pattern of incompetence with written warning, etc. before firing. It's something to look into. In the meantime, I'm sure you will find another job quickly. Will your boss give you a reference? He should--5 yrs. worth of good work should not be eliminated by one mistake. Sending hugs and prayers, and lots and lots of white light your way!

  23. Oh, here's a good one for y'all. One of the other attorneys in the office just called my cell. (Didn't answer.) Seems boss told him to call me to help him refile this pleading. Seems I'm the only one in the office that knows how to do electronic filing. I ain't feelin' cooperative. >:D

  24. Hey, I know it's tempting to ignore that call. You have been hurt and are feeling uncooperative. But---maybe if you help, it will change his mind. Do you want a shot at getting your job back, or do you want to get back at them? Take a deep breath and think it through. Now might be your best shot. And if it doesn't work, then you will know you took the higher road. That always counts for a lot.

  25. You know, if I were you and the job market for paralegals in the area isn't completely awful... you should only cooperate if you get your job back. Otherwise, let your former boss fully realize the wisdom of having canned you prior to refiling the motion electronically.

    (He deserves to reap the hassles inherent in his too-hasty decision.)

  26. I'm so sorry, Bella. It sounds like you were good at your job and boss let you go because his ego took a blow.

    Good for you for not answering the phone to help them after being fired. Especailly to help do something that you were just fired for doing wrong. Is your boss really so full of himself that he thinks you would help him out after he canned you?

    I love it when they do that. My son-in-law's job was eliminated; they combined three people's jobs into two jobs. They had the gall to ask him to train both of the people who were taking over his duties. They only gave him three days notice and he took his vacation time on those three days since they said they wouldn't pay it to him. (Turns out they were wrong and had to pay him the entire three weeks he had earned.) It's been four weeks since he left and he is still getting calls on a daily basis. He helped them to start with because he felt sorry for the people who got extra duties dumped on them, but now he's found out that the company has told the other two guys that there's no reason to pay for training when they can just call my son-in-law. He's stopped taking their calls, but he did send them a contract for his consulting services.

  27. Whether or not you help get the amended pleading filed depends on whether or not you want your job back. I wouldn't blame you for leaving them twisting in the wind. It might just be the wake-up call your boss needs to beg you to come back.

    Your boss is upset because he made himself look like a fool by trying to delegate his responsibility for the accuracy of a pleading on you. In Oregon, if an attorney files a pleading with the court, the attorney is certifying the accuracy of its contents. Allowing someone else to sign the attorney's name for the attorney could be viewed as the attorney perpetrating a fraud on the court. I don't know if the same is true in your state, but your boss needs to stop allowing paralegals to practice law for them. (No offense to you intended here. I'm sure you could out-lawyer lots of lawyers in your area!)

  29. {{{{Bella}}}} I sorta agree with everybody. Think I'd be answering sweetly and innocently to the paralegal who called, 'But I thought I was no longer part of the team! Have I got that wrong? Is it all a terrible mistake? Or were you planning to pay me a consulting fee?'

    You do need to give your boss some wriggle room -- in that he's obviously supersensitive about looking bad, so if there's any way you can ease his path towards asking you back without him having to eat crow -- well, that's all to your advantage. But I also agree with Ann and KW -- Let him realise how much he needs you! Don't you dare do anything for nothing -- would he?

  30. I have to agree with KW on this one and know that she is an expert! You may feel bad about the filing, but it is his responsibility to know. Then to fire you and have someone else call to have you help them refile??? You must be joking--you go back to do the work and then are what out on your ear??? You are good at what you do and this man needs to control his emotions--he sure wouldn't want to show open contempt for everyone in a courtroom.
